These Terms of Service apply when you access the Isla & Co website or purchase products from us.

References in these terms to “Isla & Co”, “we”, “us” or “our” mean Isla & Co.

Isla & Co is the business contracting with customers in relation to purchases made through this website.

2. Our website and products

We aim to ensure that product descriptions, images, prices and availability shown on our website are accurate.

Colours and appearance may vary slightly because of photography, screen settings, materials and the handmade nature of some products.

Some products are handmade, poured, engraved, printed, assembled or finished individually.

Minor variations in colour, texture, pattern, positioning or finish may therefore occur and can form part of the character of the product.

This does not affect your rights where a product is genuinely faulty or materially not as described.

3. Placing an order

By placing an order, you are offering to purchase the products included in your order.

You will receive electronic confirmation after placing an order.

We may decline or cancel an order where, for example:

payment cannot be authorised;
a product is unavailable;
there is an obvious pricing or description error;
we are unable to fulfil the requested personalisation; or
we reasonably believe the order is fraudulent or unlawful.

If we cancel an order after taking payment, the amount paid for the cancelled order will be refunded.

4. Prices and payment

Prices are shown in pounds sterling unless otherwise stated.

Any applicable delivery charges will be shown before you complete checkout.

We may change prices from time to time, but a price change will not affect an order that we have already accepted.

5. Personalised products

You are responsible for checking all information supplied for personalisation before placing your order.

This includes names, dates, messages, spelling, punctuation and other requested details.

We will normally reproduce the information supplied to us.

We may refuse a personalisation request that is unlawful, abusive, discriminatory, threatening, infringing or otherwise inappropriate.

6. Handmade products

Some Isla & Co products are handmade or individually finished.

Natural or handmade products may display minor differences between items.

Such variations do not affect your statutory rights if a product is faulty, not as described or otherwise fails to meet applicable legal requirements.

7. Availability

All products are subject to availability.

If an item becomes unavailable after you place an order, we will contact you and offer an appropriate solution.

This may include an alternative product with your agreement, a later delivery date or a refund.

8. Delivery

Delivery prices, methods, processing times and estimated delivery times are set out in our Shipping Policy.

Personalised and made-to-order products may take longer to prepare than standard products.

9. Returns and cancellations

Your cancellation, return and refund rights are explained in our Refund, Returns & Cancellations Policy.

Most eligible non-personalised products purchased online may be cancelled within the applicable statutory period.

Goods genuinely made to your specification or clearly personalised are generally excluded from ordinary change-of-mind cancellation rights.

Nothing in these terms limits your rights where goods are faulty, damaged or not as described.

10. Gift messages and greeting cards

Where we provide a greeting-card or gift-message service, you are responsible for checking your message before completing your order.

We may refuse to reproduce content that is unlawful, abusive, discriminatory, threatening, infringing or otherwise inappropriate.

11. Intellectual property

Unless otherwise stated, the Isla & Co name, branding, original website content, original product designs, photographs, graphics and written materials belong to Isla & Co or are used with permission from their respective rights holders.

You may use the website for normal personal shopping purposes.

You must not reproduce, distribute or commercially exploit protected content without permission.

12. Third-party services

Our online store is hosted by Shopify.

We may also use third-party providers for services including payment processing, delivery, analytics, marketing and customer communications.

Third-party services may be subject to their own terms and privacy notices.

13. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful.

This includes liability that cannot legally be excluded for faulty or misdescribed goods, fraud, or death or personal injury caused by negligence.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed, subject always to your statutory rights.

14. Events outside our control

We are not responsible for delays caused by circumstances outside our reasonable control.

Where such circumstances materially affect an order, we will take reasonable steps to minimise the effect and will contact you where appropriate.

The terms applying to your purchase will normally be those in force when you place your order, except where a change is required by law.

Nothing in these terms removes consumer rights or jurisdictional rights that cannot legally be excluded.
